User Accounts

Account Creation

To access certain features of our services, you may be required to create an account. You agree to:

1. Provide accurate, current, and complete information during registration;
2. Maintain and promptly update your account information;
3. Maintain the security of your password and account;
4. Accept responsibility for all activities that occur under your account; and
5. Notify us immediately of any unauthorized use of your account.

Account Security

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. We encourage you to use a strong, unique password for your account.

Acceptable Use

7. Attempt to gain unauthorized access to our systems;
8. Post content that is defamatory, obscene, abusive, or promotes illegal activities;
9. Infringe upon intellectual property rights of others; or
10. Engage in any activity that could damage, disable, or impair our services.

Intellectual Property

Our Content

The Site and its original content, features, and functionality are owned by Fossys and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any content you submit, post, or display on or through our services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing our services to you.

You represent and warrant that you own or have the necessary rights to all content you submit and that your content does not violate any third-party rights.

Third-Party Services

Our services integrate with third-party platforms including but not limited to:

1. TikTok
2. YouTube
3. Instagram
4. Facebook
5. Twitter/X
6. LinkedIn
7. Bluesky

When you connect these third-party services to your account, you agree to:

1. Comply with the terms of service of each third-party platform;
2. Only connect accounts you own or are authorized to manage;
3. Take responsibility for all content posted through our services to these platforms; and
4. Acknowledge that third-party services may change or discontinue their APIs at any time.

We are not responsible for the actions, content, or policies of any third-party platforms. Your use of third-party services is at your own risk.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

1. Implied warranties of merchantability;
2. Fitness for a particular purpose;
3. Non-infringement; and
4. Uninterrupted or error-free service.

We do not warrant that our services will meet your specific requirements or that any errors will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOSSYS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

1. Any indirect, incidental, special, consequential, or punitive damages;
2. Loss of profits, data, use, goodwill, or other intangible losses;
3. Damages resulting from unauthorized access to your account;
4. Damages resulting from third-party services or content; or
5. Any damages exceeding the amount paid by you to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Fossys and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any third-party rights.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including without limitation:

1. Breach of these Terms;
2. Violation of applicable laws or regulations;
3. Conduct that we determine is harmful to other users or our business; or
4. At our sole discretion for any other reason.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our services shall be resolved in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fossys regarding the use of our services and supersede any prior agreements between you and Fossys.
